INVISTA is seeking an experienced Intellectual Property Manager to provide legal support and case management activities to the Senior Counsel, Trademark and Marketing. This position may be based out of our Wichita, KS site or our Wilmington, DE site.
The ideal candidate should have a broad understanding of IP concepts and substantive US and International trademark law; works well under pressure with tight deadlines and ability to multi-task and handle unanticipated situations effectively; online research skills, a high degree of organization and attention to detail; excellent oral and written communication skills and be able to work independently and as part of a team.
Responsibilities include the following:
- Conduct foreign and domestic trademark searches, including on-line searching and working with agents, to determine availability of trademarks.
- Create summary reports and draft clearance opinions on a global basis to discuss with business clients.
- Prepare and file domestic trademark applications. Instruct foreign associates to initiate new application filings and coordinate prosecution of applications.
- Manage process and workflow of worldwide trademark filings, prosecution, renewals and conflicts (oppositions, cancellations, infringements, and counterfeits).
- Maintain database and docketing system, including data entry and reporting.
- Review watch notices for potential conflicts, initiate oppositions against third parties infringing marks and work with attorneys to manage trademark conflicts.
- Handle customs seizure actions.
- Assist Senior Trademark and Marketing Counsel with preparation of draft demand letters, settlement agreements, co-existence agreements, undertakings and foreign and domestic agreements.
- Review advertising, promotions and packaging to identify trademark and marketing issues.
Required Skills, Education, and Experience:
- 5+ years of global trademark experience at both law firms and/or in-house.
- Must possess extensive knowledge of both foreign and domestic trademark law, regulations, policies and processes to prosecute trademark applications and guard against third-party infringements and counterfeits.
- Proficiency in Westlaw/LexisNexis, CT Corsearch and/or Thomson Reuters and Outlook, Word, Excel, PowerPoint and Adobe Acrobat software packages.
- Proficiency in using standard trademark docketing systems
- Experience with copyright and/or marketing review.
- Experience successfully managing multiple competing priorities.
Preferred Skills, Education, and Experience:
- Bachelor`s Degree or higher in Business or other related program from an accredited college or university
- Paralegal Certificate
